Phillips Lytle Real Estate Law Guidance

The Commercial Leasing attorneys at Phillips Lytle provide legal counsel beyond the drafting and negotiation of a commercial lease. The team also provides training and other vital guidance to our clients as needed.

Our attorneys have assisted clients in the establishment of policies and procedures on issues involving the creation of standard forms of leases and lease abstracts, and the establishment of procedures for review and processing of leases. Our advice has included determining insurance coverage, environmental reviews, design, engineering and risk management issues, implementation of real estate tracking software and the establishment of standardized leasing requirements on key issues.

Our team has also trained in-house real estate personnel with respect to administrative matters such as estoppel requests, non-disturbance agreements, storage agreements and temporary licenses. We have worked with in-house construction departments and project managers, as well as outside consultants, with respect to architectural agreements, general contractor and subcontractor agreements, allocation of build-out responsibility, land use and zoning approvals, and overseas fabrication of point-of-purchase and sign fixtures.

We have also provided counsel on commercial lease matters such as landlord and lender consents, and transfers of properties in connection with corporate mergers and acquisitions. Environmental due diligence, compliance and remediation programs, and sales of real estate portfolios are among the matters our attorneys have managed and closed. The closing of conventional and IDA-assisted financing to build-out and equip leased space is also within the purview of Phillips Lytle real estate attorneys.
